1) LEGAL INFORMATION
These conditions of sale are concluded on the one hand by Yohan FARDOUX, registered in the trade and companies register of xxx under the number SIRET 85122805600012 hereinafter called "CINETICS RACEWEAR" and on the other hand, by any natural person or legal entity wishing to make a purchase from CINECTICS RACEWEAR "hereinafter referred to as" the buyer ".

2) OBJECT
These conditions of sale are intended to define the contractual relations between CINETICS RACEWEAR and the buyer and the conditions applicable to any purchase made by the Buyer, whether the latter is professional or private.
These conditions of sale will prevail over any other general or specific conditions not expressly approved by CINETICS RACEWEAR.
CINETICS RACEWEAR reserves the right to modify its general conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the buyer.
Placing an order governed by these general conditions with CINETICS RACEWEAR implies full acceptance of these general conditions of sale by the buyer. The buyer acknowledges the same fact to have fully understood. This acceptance will consist in the fact, for the user, to validate these general conditions.
Acceptance of these general conditions presupposes that users have the necessary legal capacity for this, or failing that they have the authorization of a tutor or curator if they are unable to do so. , their legal representative if they are minors, or they hold a mandate if they act on behalf of a legal person.
3) DELIVERY
The delivery time is approximately 5 weeks from the validation of the graphic model of the suit and the provision of the customer's measurement grid.
Shipping and, where applicable, return costs are the responsibility of the customer.
4) INTELLECTUAL PROPERTY
The various graphics and designs produced by CINETICS RACEWEAR are in no case usable without the prior agreement of CINETICS RACEWEAR whatever the use.
The design option consists in requesting CINETICS RACEWEAR for a creation service subject to intellectual property law. The purchase of this service does not imply an abandonment of copyright on the part of CINETICS RACEWEAR and does not allow the buyer to use it for the production of goods by a third-party supplier. Any violation exposes the buyer to prosecution.
5) RESPONSIBILITY
The customer is responsible for the quality of the information provided when ordering concerning his identity, contact details, e-mail, body measurements, and all that may be necessary for the proper execution of his order. CINETICS RACEWEAR cannot be held responsible for the consequences which would arise from an error on this information.
The color standards chosen during order validation is the PANTONE® standard. It is up to the buyer, if he wishes to validate by his own means the correspondence of PANTONE® with the desired colors. CINETICS RACEWEAR draws the attention of the buyer to the fact that the color rendering may differ depending on the print medium. In the event of a dispute, it is the buyer's responsibility to provide a sample made of a similar material using the ordered PANTONE®.
The measurement for the production of custom items is under the full responsibility of the buyer through a measurement grid provided by CINETICS RACEWEAR which specifies the method of measurement. CINETICS RACEWEAR can not be held responsible for an incorrect measurement by the buyer.
6) RETRACTION
In accordance with the law, the buyer has a period of 14 clear days from the delivery of his order (article L121-20-2 & L121-20-4 of the consumer code and in the context of the sale remotely) to retract. This provision relates exclusively to standard products without personalization.
CINETICS RACEWEAR agrees to exchange, grant a credit or refund the article provided that it is returned intact, in its original packaging, without trace of use and accompanied by the purchase invoice, refunds exceptionally will only be done after written and recommended validation from us and within 90 days. Any product worn after acceptance of a possible refund will no longer be subject to said refund.
Items returned incomplete, damaged or soiled by the customer are not returned, exchanged or refunded.
However, the right of withdrawal may not be exercised in application of article L121-20-2 of the Consumer Code for personalized products at the request of the customer.
7) LITIGATION
These general conditions are subject to the application of French law and the exclusive jurisdiction of French courts. The language of the contract is French, any version available in a foreign language on the site has only an informative value.
In the event of a dispute, the competent jurisdiction is that of the location of the headquarters of CINETICS RACEWEAR.
If one of the clauses of these general conditions were to be declared null by a court decision, this nullity could not lead to the nullity of all the other clauses, which would continue to have their effect.
The fact, for the parties, of not availing themselves temporarily or permanently of one or more clauses of these general conditions, shall not in any case constitute waiver of availing themselves of the rest of the general conditions.
